CONTRACT / AGREEMENT OF RELEASE / WAIVER OF LIABILITY AND INDEMNITY
I understand that it is my responsibility to consult with a physician prior to my participation in the Wine, Adventure, and Yoga Holiday to Portugal (TRIP) and all of its classes and activities. I represent and warrant that I am physically fit and have no medical conditions that would prevent my participation in any of the activities on the TRIP, or will willingly decline participation. I also attest that I am age 21 or above.
I agree to conduct myself with respect toward all other participants at all times during the course of the TRIP including and not limited to refraining from disorderly conduct, drinking to excess, interfering with scheduled activities, etc.
In consideration of being permitted to participate in the TRIP and its activities, I knowingly, voluntarily and expressly waive any claim I might have against YOGA AND WELLNESS WITH ANGELINA, LLC (YOGA WITH ANGELINA), Angelina Fox, Casa do Monte, Reid Bailey, Eric Schmidt, and any of their contractors or associates, including but not limited to any claim for injury or death caused by their act or omissions, including any negligent acts or omissions.
Yoga: I am willingly participating in the yoga classes offered at Casa do Monte by YOGA WITH ANGELINA. I recognize that yoga requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.
Activities: I understand the TRIP includes activities outside of practicing yoga and I take full responsibility for my participation in any activities on the TRIP. I also agree to consume alcohol responsibly and without excess and understand that I will not operate a vehicle or other equipment such as a boat, kayak, bicycle, etc., while under the influence of alcohol. I further agree that any harm to myself or others while under the influence of alcohol is solely my own responsibility.
If I participate in water activities I attest I am able to swim or will wear a personal floatation device at all times on the water. I further agree to abide by all local and international laws applicable to water activities as well as the policies set forth by the company I am renting equipment from or utilizing their services.
Transportation: I agree to be at the designated meeting location at the designated time in Porto, Portugal (TBD) in order to ride with the group to the villa on September 24, 2023. I understand that if I am not on time, it is my responsibility to arrange my own transportation to the villa at my own expense. I may also elect to rent a car and transport myself around during the TRIP, and assume all risk and liability thereof.
I understand that my passport must be up to date and not expire within six months of my departure date from Portugal. I also understand it is my responsibility to follow up-to-date and current border policies and travel restrictions for Portugal, the European Union, or any countries I may travel through or to on this itinerary, including any restrictions related to COVID-19 or other contagious diseases, and to follow all applicable laws and policies. I am solely responsible for the purchase and payment of my airfare and any other transportation to the designated meeting point in Porto, Portugal and for my return after the TRIP. I further agree if I rent a car and attend any activities and/or transport myself to any activities as part of the TRIP, it is my financial and personal liability to do so.
Allergies: I understand that, although I will not be required to handle products I am allergic to, there is a possibility that I will come into contact with nut, dairy, wheat, etc. products. I assume full responsibility for any adverse reactions due to exposure to any allergens. I also understand that vegan, gluten-free, dairy-free, and other restrictive diets will not be accommodated on the TRIP, and it is my responsibility to provide my own food if I require special food accommodations.
Cancellation Policy: I understand that my deposit is not refundable. Installment and final balance payments will not be refunded unless the participant’s space can be filled by someone from a waiting list. Any refunds issued will be less a $140 transaction fee and the deposit. No refunds are guaranteed. If YOGA WITH ANGELINA must cancel the TRIP due to insufficient enrollment, the deposit and all payments will be refunded fully. Any other monies paid by me, the participant, to participate such as airfare, travel insurance, etc, are the full responsibility of me, the participant, and will not be compensated by YOGA WITH ANGELINA in the event the TRIP is canceled. I fully understand and agree to the cancellation policy.
Payments: I agree to make all payments on time, and I understand that if I do not, my spot may be offered to someone on the waiting list with no refund of any monies paid. I agree I will pay $500 deposit to reserve my spot when I register, $1,000 by March 24, 2023, and the remaining amount by July 1, 2023, unless I am paying in full, in which I agree to pay all monies up front. I understand that failure to pay all money due forfeits my spot on the TRIP even if I have already purchased my plane tickets. I have read the above refund and cancellation policy.
Accident/Health/Auto/Trip Insurance: I understand I am responsible for my own insurance.
Media: I understand that participation in the TRIP may include photographs and/or video, and that YOGA WITH ANGELINA may use these images/videos for marketing and design purposes with no financial compensation for myself.
By registering for the TRIP, I agree to all Terms of the above Agreement of Release & Waiver of Liability as well as the Full TERMS OF LIABILITY.
